What changed in 3.1.0: direct one-to-one voice and video calls are now covered. Section 16 sets out who may call whom, the verification requirement in Guide Mode, the reply requirement in Butterfly Mode, the fact that calls are not recorded, and the daily limit. Section 20 adds the camera permission and the widened microphone use.
These Terms of Service ("Terms") are a binding contract between you and YoYo. They govern your access to and use of the YoYo mobile application and every feature inside it, including Guide Mode and Butterfly Mode (together, the "Service").
Please read these Terms in full. They include important provisions about what you may and may not post, how we moderate content, what our reservation feature does and does not promise, how we handle reports of objectionable content and abusive users, the limits of our liability, and how disputes are resolved. Section 35 contains an agreement to resolve disputes by individual arbitration and a class-action waiver that applies to users who contract with YoYo LLC, together with a right to opt out. Section 36 expressly excludes users in Japan from arbitration and gives them the Japanese courts instead.
If you do not agree to these Terms, do not create an account and do not use the Service.
WHAT CHANGED IN THIS VERSION
We rewrote several Sections because the app changed and because the previous version described some things less precisely than it should have. In summary: Section 13 now describes moderation as it actually runs, including that a comment is published first and screened immediately afterwards, and that a chat message is checked on your device before it is sent and again on our servers after it arrives. Section 14 states plainly that Guide Mode's Hide User is mutual and permanent and that there is no block control in Guide Mode. Section 18 restates that a reservation is an attempt and never a guarantee, and names the dietary and allergy information that goes to our booking agent and to the venue. Section 21 corrects what verification proves. Section 23 adds our staff-alert email provider, names crash diagnostics, and states plainly that analytics cannot be switched off in the app today and that there is no self-service data export. Section 31 corrects what account deletion removes and what it does not reach. Nothing in this version takes away a right you had under version 2.0.0.

1. ACCEPTANCE OF THESE TERMS
1.1 You accept these Terms by tapping to accept them at sign-up, or by accessing or using the Service. Accounts are personal. You may not open one on behalf of another person or on behalf of an organisation.
1.2 These Terms incorporate by reference the YoYo Privacy Policy and the YoYo End User License Agreement, both available inside the app under Settings. Where these Terms and the Privacy Policy address the same subject, the Privacy Policy governs how we handle personal information and these Terms govern your rights and obligations as a user.
1.3 If you do not understand a provision of these Terms, write to support@yoyodatingapp.com before you accept. We will explain it.
1.4 We record the fact and the date of your acceptance, and the version number you accepted, on your account.
2. WHO WE ARE, AND WHICH ENTITY YOU ARE CONTRACTING WITH
2.1 YoYo is operated by two affiliated companies:
- YoYo LLC, a limited liability company with its business address at 453 S Spring St STE 400 PMB1290, Los Angeles, CA 90013, United States.
- YoYo KK, Ltd., a company with its business address at 566 Tensho Office Hamamatsucho Daimon, Eagle Hamamatsucho, 2-7-17 Hamamatsucho, Minato-ku, Tokyo 105-0013, Japan.
2.2 If the country associated with your YoYo account is Japan, your contract for the Service is with YoYo KK, Ltd., and "YoYo", "we", "us" and "our" in these Terms mean YoYo KK, Ltd. If the country associated with your account is any other country, including the United States, your contract is with YoYo LLC, and "YoYo", "we", "us" and "our" mean YoYo LLC.
2.3 How the country associated with your account is worked out. We derive it from the country code of the telephone number you gave us, from the country your device reports with your location permission, and from your device language, in that order of preference. It is not a declaration you make separately, and it can be wrong, for example if you use a foreign phone number. If the country on your account is wrong and it matters to you, write to support@yoyodatingapp.com and we will correct it.
2.4 Both companies operate the same Service on a shared technical platform. Each acts as a service provider to the other for the purpose of operating the Service, and personal information may be handled by both, as described in the Privacy Policy. Whichever entity you contract with, you may raise any issue at support@yoyodatingapp.com and it will reach the right company.
2.5 Nothing in Section 2.2 limits any right you have under the mandatory consumer-protection law of the country where you live.
3. ELIGIBILITY AND AGE
3.1 The Service is for adults only. You must be at least 18 years old to create an account or to use the Service. There are no exceptions, and there is no parental-consent route.
3.2 How we apply that rule, stated exactly. At sign-up you must enter your date of birth. If the date you enter shows that you are under 18, you cannot complete registration. The date of birth you entered is stored on your account, and the same date is checked again when you enter Butterfly Mode. By creating an account you represent and warrant that you are 18 or older and that the date of birth you entered is truthful.
3.3 The honest limit of that check. We check the date of birth on your account. We do not independently verify the age of every user, and we do not require a document from everyone. If an account has no usable date of birth on file - which can happen with an account created before the current sign-up flow, or where the stored value cannot be read - the automatic check cannot run, and we do not lock that account out on that basis alone. In those cases we rely on review, on reports from users, and on the checks described in Section 21 if the account holder chooses ID verification. We therefore do not claim, and you should not assume, that every account on YoYo has been proven to belong to an adult.
3.4 ID verification. We may additionally ask you to complete ID verification, and you may choose it yourself. Section 21 explains what it involves and what it does and does not prove. It is optional for ordinary use of the Service; some features are gated on it.
3.5 If we learn or reasonably believe that an account holder is under 18, we will terminate the account without notice and delete the account data in accordance with the Privacy Policy, retaining only what we must retain to enforce our rules and meet legal obligations. If you believe a minor is using YoYo, report it immediately in the app or to support@yoyodatingapp.com with the word MINOR in the subject line. We treat these reports as our highest priority and act on them ahead of everything else.
3.6 You may not use the Service if you have previously been removed from it, if you are legally barred from using an online dating or social-discovery service, or if you are required to register as a sex offender in any jurisdiction. You may also not use the Service if you have been convicted of, or have pleaded guilty or no contest to, a felony or indictable offence involving sexual assault, sexual abuse, the sexual exploitation or abuse of a child, homicide, kidnapping, stalking or domestic violence. This bar is absolute and does not depend on your own view of whether you present a risk to anyone. By using the Service you represent that none of these applies to you, and if one of them later does, you must stop using the Service and delete your account. Nothing in this Section requires us to run a background check, and Section 19.1 states plainly that we do not.
3.7 You may not use the Service if you are located in, or ordinarily resident in, a country subject to a United States Government embargo or designated by the United States Government as a "terrorist supporting" country, or if you are listed on any United States Government list of prohibited or restricted parties. By using the Service you represent that neither of these applies to you.
4. YOUR ACCOUNT AND ACCOUNT SECURITY
4.1 One account per person. You may hold only one YoYo account. Creating or operating additional accounts, including to evade a hide, a block, a suspension or a termination, is a violation of these Terms and grounds for permanent removal.
4.2 One account, two modes. Guide Mode and Butterfly Mode are two parts of one account. They are not two accounts, and you cannot have one without the other existing. Section 9 explains what that means for the separation between them, and Section 31 explains that deleting your account deletes both.
4.3 Accurate information. The information you give us at sign-up, including your date of birth and gender, and the information you present on your Guide Mode profile, must be truthful and about you. Do not impersonate another person, use another person's photographs, or present a profile that is not your own.
4.4 Security. You are responsible for keeping your sign-in credentials and your device secure, and for all activity that occurs under your account. Tell us immediately at support@yoyodatingapp.com if you believe someone else has accessed your account. We will help you secure it, and we may suspend it while we do.
4.5 No transfer. Your account is personal to you. You may not sell, rent, lend, share or transfer it, and you may not allow another person to use it.
4.6 Sign-in providers. You may sign in using Sign in with Apple, with a Google account, or with an email address and password. Your relationship with a sign-in provider is governed by that provider's own terms. If you use Sign in with Apple with the private-relay option, we receive a relay address rather than your real email address, and we use it for the same purposes.
4.7 Our security, stated honestly. We protect your account with your sign-in provider's authentication and with access rules applied on our servers. No system is perfectly secure, and ours is a work in progress. Section 23.11 sets out, without softening it, the specific limits of our access controls today, including what other signed-in users can read. Read it before you decide what to put on your profile.
5. THE SERVICE: AN OVERVIEW OF THE TWO MODES
5.1 YoYo contains two distinct modes that share one account:
- Guide Mode is the dating side of YoYo. It is identity-based: real photographs, a display name, and a profile you build. It is oriented toward meeting people in person.
- Butterfly Mode is a pseudonymous, avatar-based online social space. There are no photographs of you and no real name. It is oriented toward conversation, posting, listening and voice.
5.2 You choose which mode to open. Neither mode is compulsory, and you can use one without using the other.
5.3 The Service is provided free of charge today. See Section 22.
5.4 We change the Service. We add features, remove features, and change how features work. We will not remove something material without telling you, and Section 39 governs changes to these Terms themselves. We do not promise that any particular feature will continue to exist.
6. GUIDE MODE
6.1 Profile. In Guide Mode you build a profile containing photographs, a display name, your date of birth, your gender and your height, and, if you choose, an extensive set of optional attributes: a short bio, occupation, school, workplace, education level, activity level, smoking and drinking habits, dietary preference, languages, relationship goal, marital history, MBTI type, zodiac sign, income bracket, religion, political leaning, core values, the traits you are looking for, your interests, and the kinds of date you prefer. Optional attributes are optional; you decide what to publish. Some of these attributes - religion, political leaning, dietary preference where it reveals a religious or medical reason, and the gender preference that reveals who you are looking for - are treated as sensitive personal information under some laws. The Privacy Policy explains how we handle them.
6.2 Discovery and matching. Guide Mode includes map-based venue discovery powered by Google Maps and Google Places, Date Plans, the Venue Board, Collections of saved venues, and a point-scored matching system that considers distance, shared saved venues, shared interests, recent activity and profile completeness, subject to bidirectional gender preference. Matching is an algorithmic suggestion. It is not a compatibility guarantee, not a screening service, and not a promise that anyone is who they say they are.
6.3 Chat. Matched users can exchange messages. Guide Mode conversations and Butterfly Mode conversations are stored separately and never appear in each other's list.
6.4 YoYo Calendar and your device calendar. YoYo Calendar holds your date schedule and your availability windows. Calendar permission is used in two directions, and you should know about both. First, if you grant calendar permission, YoYo can read events from your device calendar so that your YoYo plans appear alongside your existing commitments. Second, when a date invitation is accepted, YoYo writes that date into your device calendar as an event named after the venue, with the venue address as the location. That write happens whenever calendar permission has been granted, not only when the calendar sync switch is on, and the event is created in your default writable calendar, which means that anyone you share that calendar with can see it. You can revoke calendar access at any time in your device settings, and you can delete or edit the written event yourself.
6.5 Quick Date. Quick Date advertises same-day availability to other users. Turning it on means other users can see that you are free today and can ask to join you. Quick Date requires verified status (Section 21). Only turn it on when you actually intend to meet someone.
6.6 YoYo Date Coach. An AI advisor described in Section 17.
6.7 Incognito Mode. Incognito Mode limits your visibility to other users. It does not make you invisible to YoYo, it does not remove your account record from our systems, and it does not remove your obligations under these Terms.
6.8 YoYo Reservations. Described in Section 18. Read that Section before you rely on a booking.
7. THE VENUE BOARD, DATE PLANS AND COLLECTIONS
7.1 The Venue Board is user-generated. The Venue Board is built from date plans that YoYo users create and choose to publish. It is not a curated list, not an editorial recommendation, not a ranking, and not a set of YoYo picks. We do not select the venues on it, we do not visit them, we do not verify them, and we do not endorse them. When you look at the Venue Board you are looking at what other users chose to share.
7.2 Where venue information comes from. The name, address, telephone number, website, opening information, photographs, price level, rating and reviews shown for a venue come from Google Maps and Google Places and belong to those services and their contributors. They can be out of date or wrong. A venue can close, move, change its menu or change its prices without any of that reaching us. Check with the venue before you rely on anything.
7.3 What publishing a plan does. When you publish a date plan to the Venue Board, other users of the Service can see it, including the venue, the date and the time you chose, and can ask to join it. Do not publish a plan you do not want other users to see. You can keep a plan private instead, and you can delete a plan you published.
7.4 Collections. A Collection is your own list of saved venues. Collections are for your use; they also feed the matching signal described in Section 6.2, which is how a shared saved venue can raise someone's position in your deck.
7.5 Your responsibility for a plan. A plan is a suggestion you are making to other people. You are responsible for what you write in it and for turning up if someone joins it. Section 18 governs what happens if you ask us to book the venue.
8. BUTTERFLY MODE
8.1 Identity. When you enter Butterfly Mode you receive an automatically generated pseudonymous handle and choose one of sixteen supplied two-dimensional avatars. You answer a short personality quiz that produces a five-value personality vector and assigns you a "planet", and you choose between three and eight interest tags. Butterfly Mode contains no photographs of you and no real name.
8.2 Your handle cannot be changed. The handle you are given when your Butterfly profile is created is permanent. There is no rename control, and we cannot change it for you. Your avatar, your planet and your tags can all be changed; the quiz can be retaken at most once every seven days.
8.3 Region. Your Butterfly Mode country is copied once, when your Butterfly profile is created, from the country already associated with your account. Matching pools are same-country only.
8.4 Your starting tags. When your Butterfly profile is created, your interest tags are seeded from the interests on your Guide Mode profile. This happens once, at that moment, and never again; changing your Guide Mode interests afterwards does not change your Butterfly tags, and changing your Butterfly tags does not change your Guide Mode interests. You can edit your tags freely.
8.5 The Square. The Square is the Butterfly Mode feed. You can publish text posts of up to 500 characters, up to four images per post, and short video, which we compress and for which we generate a poster thumbnail. Other users can comment (up to 300 characters), like, and follow you. Video can be browsed in a vertical, full-screen pager.
8.6 Anonymous posting. You may publish a post to the Square without a visible author. Section 10 explains exactly what that does and does not mean.
8.7 Matching and chat. A server-side queue matches you with another user in your country. It excludes users you have blocked and users who have blocked you, applies a seven-day cooldown before the same pair can be re-matched, and applies a daily limit on free matches. Butterfly Mode conversations use a separate chat list.
8.8 Voice. Voice matches and party rooms are described in Section 16.
8.9 Dust. If you have not been active for a period we set, your Butterfly profile may be flagged as "dusty", and a connection can send you a "wipe", which sends you a notification. Being flagged as dusty does not delete anything.
8.10 Presence. While Butterfly Mode is open on your screen, other users can see that you are active, and a room knows you are still on your seat. Leave the app in the background, or be inactive, for about five minutes and your seat goes to someone else who is listening.
8.11 Points and levels. Butterfly Mode displays a level and a points total. Points and levels are cosmetic, have no monetary value, are not property, credit or currency, and cannot be bought, sold, transferred or redeemed. They may be adjusted or reset if they are obtained through abuse, automation or a defect. Parts of this system are not switched on today, so your level may not move even when you are active. We will not charge you for points and we will not let you buy them.
8.12 Notifications centre. Butterfly Mode has its own in-app notifications centre. Rows are written there whether or not you have push notifications enabled. Guide Mode does not have a notifications centre.
8.13 No purchases. Butterfly Mode contains no coins, gifts, subscriptions, paid boosts or purchases of any kind.
9. THE PSEUDONYMITY FIREWALL, AND ITS HONEST LIMIT
9.1 What the firewall is, toward other users. Your Butterfly Mode profile is stored as a separate record from your Guide Mode dating profile. It carries no photograph of you, no real name, and no pointer to your dating profile. No feature of the app joins them. There is no cross-mode reveal, no "find this person's dating profile" function, and no screen that shows another user which Butterfly handle belongs to which Guide Mode profile. The two chat systems share no storage. Other users cannot connect the two.
9.2 What the firewall is not, toward us. Both profiles belong to the same YoYo account and are keyed to the same internal account identifier. We can associate them, and we will do so where it is necessary for safety, security, moderation, enforcement of these Terms, and compliance with law and lawful requests. Several ordinary parts of the Service already cross between them: your Butterfly country is derived from your Guide Mode location, your starting tags are seeded from your Guide Mode interests, one push token serves both modes, and creating a party room in Butterfly Mode is gated on the verified status you obtained in Guide Mode.
9.3 Say it plainly. Pseudonymity on YoYo is pseudonymity toward other users. It is not anonymity toward us.
9.4 Consequences cross modes. Misconduct in one mode can and will lead to consequences in the other, including suspension or termination of your whole account.
9.5 Protections do not cross modes. This is the other side of the same coin, and it is the one people get wrong. Blocking someone in Butterfly Mode does nothing in Guide Mode, and hiding someone in Guide Mode does nothing in Butterfly Mode. Section 14 sets this out in full. Do not rely on one mode's controls to protect you in the other.
10. ANONYMOUS POSTING, AND ITS HONEST LIMIT
10.1 An anonymous post on the Square is published without a visible author. Other users cannot see who wrote it, it does not appear in the Following feed, and it carries no verified badge. The post record itself does not contain your identifier at all.
10.2 We hold the authorship separately. The true author of every anonymous post is recorded by our servers in a private record that no user can read, in either mode, under any circumstances. We use that record to let you delete your own anonymous post, to find and erase your anonymous posts when you delete your account, to moderate and enforce these Terms, to investigate reports, to respond to legally valid requests from courts, law enforcement and regulators, and to comply with legal obligations.
10.3 Reporting an anonymous post does not identify you to its author, and it does not identify the author to you. The report goes to our team.
10.4 In plain words: anonymous posting hides you from other users. It does not hide you from YoYo, and it will not protect you if you use it to harass, defame, defraud or harm someone. Do not treat anonymous posting as a shield.
10.5 One circumstance discloses you to a private party. If you file a counter-notification under Section 28 about an anonymous post that was removed on a copyright notice, the law requires your real name, address and telephone number to be passed to the complainant. Section 28.8 explains this before you act on it. There is no other route by which we hand the author of an anonymous post to a private party without a legally valid order.
11. YOUR CONTENT: OWNERSHIP, LICENCE, AND YOUR PROMISES
11.1 "Your Content" means everything you submit, post, transmit or display through the Service: profile text and photographs, Square posts, images, video, comments, chat messages, room titles, date plans, reservation notes, reports you file, feedback, and anything else you create in the app.
11.2 You keep ownership. You retain all ownership rights you already have in Your Content. These Terms do not transfer any ownership to us.
11.3 The licence you grant us. You grant YoYo a worldwide, non-exclusive, royalty-free, sublicensable (only to our service providers, and only so that they can perform services for us) and transferable (only as part of an assignment permitted by Section 40) licence to host, store, cache, reproduce, adapt in a purely technical sense (for example resizing, compressing, transcoding and generating a video poster frame), publish, publicly display and distribute Your Content, solely for the purposes of operating, providing, securing, moderating and improving the Service and complying with law. This licence exists so that we can show your post to the people you posted it to and keep the Service running.
11.4 Private messages are treated differently. This licence does not apply to your private communications in the way it applies to content you publish. Messages you send in a Guide Mode or Butterfly Mode conversation, and messages in the text rail of a party room, are transmitted to the people you sent them to; we do not publish them, publicly display them or distribute them to anyone else. We access private messages to screen them as described in Section 13, to investigate a report, to enforce these Terms, to operate and secure the Service, and where the law requires it. This licence does not permit us to sell Your Content, to license it to advertisers, or to use it in marketing without your separate permission.
11.5 We do not train models on your content. We send content to OpenAI for the purposes described in Sections 13 and 17, under a commercial API arrangement, in order to get an answer back. We do not sell your content to anyone for the training of AI models and we do not run our own training on it.
11.6 Duration. The licence in Section 11.3 ends when Your Content is deleted from our live systems, except that (a) copies retained in backups, logs, and moderation or safety records persist for the periods described in the Privacy Policy and in Section 31, and (b) content that other users have already saved, screenshotted, quoted or re-shared is outside our control and outside the reach of a deletion.
11.7 Feedback. If you send us suggestions or feedback about the Service, we may use them without obligation or compensation to you.
11.8 Your representations. For all of Your Content, you represent and warrant that:
- you own it or have all rights and permissions necessary to post it and to grant the licence in Section 11.3;
- it does not infringe anyone's copyright, trademark, privacy, publicity, or other rights;
- every identifiable person in a photograph or recording you post has consented to your posting it;
- it is not unlawful, and it does not violate Section 12; and
- it is not sponsored or paid content that you have failed to disclose.
11.9 We are not the author. YoYo does not create Your Content and does not adopt or endorse it. We do not pre-approve most content for accuracy or truthfulness, and no statement made by another user should be treated as a statement by YoYo. Section 13 explains what moderation we do perform, and where it stops.
12. COMMUNITY STANDARDS AND PROHIBITED CONDUCT
These standards apply in both modes and on every surface: profiles, photographs, Square posts, comments, chat messages, voice matches, party rooms, room titles, handles, date plans, reservation notes and reports.
12.1 Child safety - zero tolerance. Any content that sexualises a minor, any attempt to solicit, groom or sexually exploit a minor, and any sexual or romantic approach to a person you know or suspect to be under 18 is absolutely prohibited. We remove it, terminate the account permanently and immediately, preserve the evidence, and report it to law enforcement and to the appropriate child-protection authorities. There is no appeal from a child-safety termination.
12.2 Harassment and abuse. No harassment, bullying, stalking, intimidation, repeated unwanted contact after someone has disengaged, coordinated pile-ons, or sexual harassment. "No" ends a conversation.
12.3 Hate speech and discrimination. No content that attacks, dehumanises, demeans or promotes violence, hatred or exclusion against a person or group on the basis of race, ethnicity, national origin, caste, immigration status, religion, disability, disease, age, sex, gender, gender identity or expression, or sexual orientation. No hate symbols, no slurs.
12.4 Sexual content and nudity. No sexually explicit content, no pornography, no nudity, no depictions of sexual acts, and no sexually explicit avatars, handles, room titles or profile text. Do not send unsolicited sexual images or sexual messages to anyone. Sharing an intimate image of another person without that person's consent is prohibited absolutely and is grounds for immediate termination.
12.5 Violence and threats. No threats of violence, no incitement to violence, no glorification of violence or of violent extremism, no terrorist or violent-extremist content, and no graphic gore.
12.6 Self-harm and suicide. No content that encourages, instructs in, or glorifies suicide, self-harm or disordered eating. If you are in crisis, please contact your local emergency number or a crisis line. YoYo is not a crisis service and cannot provide emergency help.
12.7 Illegal goods and activity. No sale, purchase, promotion, gifting or facilitation of illegal drugs, prescription medicines, weapons, ammunition, explosives, endangered wildlife, counterfeit goods, stolen goods, forged documents, hacked accounts or hacking services, and no other unlawful activity.
12.8 Commercial sex, compensated dating and trafficking. No prostitution, no escort services, no solicitation of or offer for commercial sexual services, no sugar-dating arrangements offered in exchange for money or goods, and no compensated dating, known in Japan as 援助交際. No content that facilitates human trafficking or sexual exploitation of any kind.
12.9 Scams, fraud and money. No romance fraud. No investment, cryptocurrency, foreign-exchange or "trading mentor" pitches. No asking other users for money, gift cards, crypto, wire transfers or financial help, whether by telling a hardship story, inventing an emergency, or building affection first. No phishing, no fake links, no malware. If another user asks you for money, do not send it. Report them.
12.10 Spam and commercial use. No spam, no bulk or repetitive messaging, no unsolicited advertising, no promotion of other apps, services, events or fundraising campaigns, no recruitment, no affiliate links, and no use of the Service for any commercial purpose. The Service is for your personal, non-commercial use. This includes the Venue Board: do not publish a plan in order to advertise a business, including your own.
12.11 Impersonation and misrepresentation. Do not impersonate another person, a public figure, a company, or YoYo or its staff. Do not use another person's photographs. Do not misstate your age.
12.12 Privacy of others, doxxing and recording. Do not publish another person's private information, including their real name where they use a pseudonym, home or work address, phone number, email, workplace, identification documents, financial information, or their location. Do not publish screenshots of private chats in order to expose or harass someone. Do not attempt to work out which Guide Mode profile belongs to which Butterfly handle, and do not publish a claim about it. Do not record, transcribe or stream another user's voice without that user's consent (see Section 16.7).
12.13 Contact harvesting and off-platform pressure. Do not systematically collect other users' contact details, and do not pressure someone to move to another platform, to send you photographs, or to disclose personal information. It is normal and permitted to exchange contact details consensually with someone you have chosen to talk to; it is not permitted to harvest them.
12.14 Automated access and interference. Do not scrape, crawl, index, mirror or bulk-download the Service or its content. Do not use bots, scripts, automation frameworks, emulator farms or modified clients. Do not reverse engineer, decompile or disassemble the app except to the extent that applicable law expressly permits it despite this restriction. Do not read, write or modify data in our systems other than through the app's own screens; in particular, do not use our backend directly, do not read another user's records, and do not write to records that are not yours. Do not probe, scan or test the vulnerability of our systems, defeat our anti-abuse measures, circumvent rate limits, or interfere with the Service or with other users' use of it.
12.15 Circumventing enforcement. Do not create a new account, use another person's account, or use technical means to evade a hide, a block, a suspension, a termination, a device ban or a room ban.
12.16 Misuse of reporting. Do not file knowingly false reports, and do not organise groups to mass-report a user you dislike. Coordinated false reporting is itself a violation.
12.17 Misuse of reservations. Do not use YoYo Reservations to make bookings you do not intend to keep, to make bookings in someone else's name without their agreement, to block out a venue's availability, or to harass a venue. Section 18 sets out your obligations to the venue.
12.18 Legal compliance. Do not use the Service in violation of any applicable law, including the laws of Japan and of the United States and its states.
12.19 All of this applies equally to anonymous posts and to voice. Speaking a prohibited thing in a party room is the same violation as typing it, and posting it without a visible author is the same violation as posting it under your handle.
13. HOW MODERATION ACTUALLY WORKS, AND WHERE IT STOPS
We want you to know exactly what protection you have, so this Section is deliberately specific about the limits. Read 13.3 and 13.4 as carefully as you read 13.2.
13.1 Two layers. Content is judged by two things working together. The first is a word-based layer that runs on our own servers, catches profanity, slurs and their disguised spellings, and does not depend on any outside service. The second is OpenAI's omni-moderation service, which scores content against categories such as sexual content, violence, self-harm, harassment and hate. What we send to OpenAI is described in Section 17.4 and in the Privacy Policy. Thresholds are set by us on the server and can be tightened without an app update.
13.2 What is screened, and when. The timing differs by surface, and the difference matters:
- Square posts. A post is created invisible to everyone else and stays invisible until its text and its attached images have been screened. A post that passes becomes public. A post that fails is blocked and never appears, and its author is notified. Nothing else sees it in between.
- Video on the Square. Screened on the poster frame that the app generates. See 13.3.
- Comments on Square posts. A comment is published immediately and screened straight afterwards by a process on our servers. A comment that fails is deleted and its author is notified. This means a comment that breaks these Terms can be visible for a short period - normally seconds - before it is removed.
- Chat messages, in both modes. A message is checked before your device sends it, and that check fails closed: if we cannot get a definite verdict, the message is refused and you are told the check could not be completed. It is checked again on our servers after it arrives, because the first check runs in the app and an app can be modified. If the second check catches something the first missed, the message text is emptied where it stands and marked as removed, and the preview in the chat list is emptied with it. Both people see it change. Understand what that means: the other person may already have read the message, and may already have received a push notification containing the first part of it. We cannot unsend what has already been delivered.
- Party room text rail. Same as chat.
- Party room titles. Screened when the room is created; a title that fails is refused and the room does not open. If that check times out, the room opens and a process on our servers re-judges the title moments later and can close the room.
- Display name, handle and profile bio. Screened before they are saved.
- Guide Mode profile photographs. A photograph is uploaded to our storage first and screened afterwards, because screening an image means giving its address to OpenAI, which fetches the image itself. A photograph that fails is deleted from our storage, is never written to your profile and is never shown to anyone. It does exist in our storage for the few seconds in between, and we would rather tell you that than describe a sequence that does not happen.
- Date plan and Venue Board text. Screened before it is published.
- Icebreaker suggestions. Screened, and filtered to remove contact details, before they are shown to you.
13.3 What is not screened, stated plainly.
- Video is not scanned frame by frame. We screen the poster frame only. Every later frame is unscreened, and the audio track of a video is not screened at all. The poster frame is generated by the app on your device, and we do not prove that it came from the clip it is attached to.
- Live voice in voice matches and party rooms is not screened, in real time or afterwards, and cannot be with how the Service is built. We do not receive that audio. Section 16.5 explains this in full.
- We do not read your private messages routinely. They pass through the screening described above and are otherwise looked at only for the reasons in Section 11.4.
13.4 When screening degrades or fails. Screening runs as a request from the app to our servers and from our servers to OpenAI. Three things follow, and none of them is hypothetical:
- Chat during an outage. If OpenAI cannot be reached in time, chat does not stop. The word-based layer still runs, so profanity and slurs are still caught, but the judgement of intent is lost - a message like "I know where you live" contains no listed word and would pass. Messages sent in that window are marked internally and re-judged by a later sweep, which can empty a message minutes after it was sent.
- Daily allowance. Each account has a daily screening allowance, which exists to control cost and to stop someone using the screening service as a free tool. If you exceed it, further content is allowed through with the word-based layer only.
- Classifiers are wrong in both directions. They miss things they should catch and they block things they should not. If clean content of yours was blocked, tell us at support@yoyodatingapp.com and we will look at it.
Automated screening is a filter, not a guarantee, and you must not rely on it as one. Reporting, blocking, the automatic hiding in 13.6 and human review are what catch the rest.
13.5 User reports. Every surface of the Service carries a way to report: posts, comments, profiles, party rooms, live voice matches and chat all have a report control, and Guide Mode chat additionally has a quick-flag control. A report about a voice surface also records the room or channel identifier so that we can investigate the session.
13.6 Automatic hiding at three reports. When a piece of content on the Square has been reported by three or more distinct users, it is hidden from other users automatically, pending human review. Hiding is not a finding of guilt; it is a precaution while a person looks.
13.7 Human review. Reports go into a single moderation queue that covers both modes and is reviewed by our team. We look at the reported content, the context, the reporting history and the account history. A human being makes every enforcement decision that suspends or terminates an account.
13.8 Our commitment on objectionable content. When we receive a report of objectionable content or abusive behaviour, we will review it and act within 24 hours of the report. Acting means, where the report is substantiated, removing the offending content and ejecting the offending user from the Service. Depending on severity we may instead or additionally issue a warning, restrict a feature, suspend the account, or terminate it permanently. We will not always be able to tell you the specific outcome for another person's account, because their account is their private matter, but we will confirm that the report was handled. Reports involving child safety, credible threats of violence, or non-consensual intimate imagery are escalated immediately and are not held for the full review window.
13.9 Records of moderation. When automated screening removes or empties a piece of content, we create an internal safety record of it. That record can contain a copy of what was written - for a chat message, up to the first 1,500 characters of it. Section 31.6 explains that these records are retained after an account is deleted, and why.
13.10 Good faith and imperfection. We moderate in good faith, but moderation at scale is imperfect and we do not promise to detect or remove every violation. Nothing in this Section creates a duty to monitor all content, and our decision to moderate some content does not make us the author or publisher of user content or make us responsible for content we did not remove.
13.11 We may act without a report, where we identify a violation ourselves, where the law requires it, or where we reasonably believe there is a risk to a person's safety.
14. REPORTING, BLOCKING AND HIDING: WHAT EACH CONTROL ACTUALLY DOES
The two modes give you different tools, and we would rather set that out precisely than let you rely on a protection you do not have. Every control below is unilateral, takes effect immediately, and does not notify the other person.
14.1 Reporting, in both modes. You can report a post, a comment, a profile, a party room, a live voice match, and a chat. Choose the closest reason and add detail if you can. A report goes to one moderation queue that covers both modes, and an enforcement action can be applied to the whole account. Reporting is what gets an account itself looked at, and a report we uphold removes that person from YoYo entirely. Reporting an anonymous post does not reveal you to its author.
14.2 Butterfly Mode: a real block. Blocking someone in Butterfly Mode stops that person appearing to you or interacting with you anywhere in Butterfly Mode - the Square, comments, profiles, matchmaking, chat and voice matching - and it works in both directions, so neither of you reaches the other. It is enforced by rules on our servers, not only in the app. You can undo it from the same menu.
The one exception is party rooms. They are public, host-moderated spaces, and a blocked person is not kept out of a room you are in. The host can mute, remove or ban anyone, and you can report or leave at any time.
14.3 Guide Mode: there is no block, and Hide User is permanent. Guide Mode does not have a block control today. What it has is:
- Hide User. This removes that person from your match deck. It is mutual: it also removes you from theirs. And it cannot be undone. There is no unhide control anywhere in the app, and we do not have one either. Use it when you are sure.
- Unmatch. This ends the match, deletes the conversation, removes each of you from the other's match deck, and applies the same permanent mutual hide. Unmatching is what ends contact with someone you have matched with.
- Report User. This sends the account to our safety team, as 14.1 describes.
14.4 The two modes do not share these lists. This is the part people assume wrongly, so we will state it without hedging. Blocking someone in Butterfly Mode does not hide them from your Guide Mode deck. Hiding or unmatching someone in Guide Mode does not block them in Butterfly Mode. There is no cross-mode block, there is no shared list, and one control does not create the other. Because the two profiles carry no photographs, no real name and no link between them, you will usually not be able to tell that a Guide Mode account and a Butterfly handle belong to the same person.
14.5 What to do if someone is troubling you in both modes. Use the controls in each mode where you encounter them, and report them. A report reaches one queue that covers both modes, and an enforcement action on the account applies to the whole account. That is the route that works across the firewall; the per-mode controls are not.
14.6 A direct block control for Guide Mode is planned. Until this Section says otherwise, it does not exist. We will update this Section when it ships rather than leave stale text here.
14.7 Nothing in this Section limits what you can do outside YoYo. If someone is harassing or threatening you, contact your local police. We will cooperate with a lawful request for information.
15. HOW TO REACH US, AND HOW FAST
15.1 In the app: use the report control on the post, comment, profile, room, voice match or chat concerned, and choose a reason. To stop contact, use the controls in Section 14.
15.2 By email: support@yoyodatingapp.com. Tell us what you saw, where you saw it (mode, screen, handle or display name, and approximate time), and what you would like us to do. Attach screenshots if you have them. Write in English, Japanese or Chinese.
15.3 Emergencies. If someone is in immediate danger, contact your local emergency services first. In Japan, dial 110 for police and 119 for fire and ambulance. In the United States, dial 911. Then tell us.
15.4 Our response times. We acknowledge safety reports and act within the window in Section 13.8. We aim to acknowledge every other message sent to support@yoyodatingapp.com within 3 business days, and non-safety enquiries are normally answered in full within five business days. Privacy requests have their own deadlines, in Section 23.9.
15.5 Support is provided by a small team. There is no telephone support line, and we do not offer live chat. Email is the route, and it reaches a person.
16. VOICE AND VIDEO: VOICE MATCHES, PARTY ROOMS AND DIRECT CALLS
16.1 Voice match. A voice match is a live, timed audio conversation between two matched users in Butterfly Mode. Identities are revealed only if both people choose to reveal. If the timer runs out without a mutual reveal, no conversation is created and there is no further contact.
16.2 Party rooms. A party room has a fixed number of microphone seats plus an audience, a category and a title, and a text rail beside the audio. Messages in the text rail are temporary: they are deleted, together with the room's membership, ban and mute lists, within about an hour of the room closing. A maintenance process clears seats abandoned by users who have disconnected and closes empty rooms. Creating a party room requires verified status (Section 21).
16.3 Host powers and host responsibility. The host of a party room can mute, remove and ban participants. If you host a room you are responsible for keeping it within these Terms: set an appropriate title, act on what you hear, and remove people who break the rules. Hosting a room where violations are obvious and unaddressed is itself a violation, and we can close the room and remove the host.
16.4 A limit on seat control, stated honestly. Who holds a microphone seat is controlled by the app and by rules on our database. It is not enforced by the audio provider's own permission system, which is not configured to enforce it today. In practice that means someone using a modified client could transmit audio without holding a seat. If that happens, the host can remove and ban them, anyone can report it, and we will act on the account. We are changing this configuration; until this Section says otherwise, treat seat control as a product control rather than a hard technical guarantee.
16.5 We do not record your voice, and we cannot review it. YoYo does not record the audio of voice matches or party rooms. The audio travels between participants in real time through our voice provider, Agora, and our servers never receive it. The provider's recording facility is not configured, and the transcription path in our code is not switched on. The consequence is important and we want it understood: we cannot review what was said after the fact. A report about voice is assessed on the account history, the room context and what the participants tell us. If we ever decide to record, transcribe or review audio for safety purposes, we will amend this Section and the Privacy Policy, update the data disclosures we publish on the App Store and Google Play, and give you at least 30 days' notice inside the app before it takes effect. We will not switch it on quietly.
16.6 What the voice provider does receive. Agora receives the channel identifier, a temporary numeric participant identifier that is not your YoYo account identifier, connection data, and the live audio itself, which it routes between participants through the region nearest to them. It does not receive your handle, your profile or your account identifier.
16.7 You must not record others. Do not record, screen-capture, transcribe, re-stream or otherwise capture another participant's voice without the clear consent of every participant. California, where YoYo LLC is based, requires the consent of all parties to record a confidential communication, and other jurisdictions have similar rules. Recording another user without consent is a violation of these Terms and may be a crime.
16.8 Microphone. Voice features require microphone permission, which your device will ask for and which you can revoke at any time in your device settings. The microphone is used only while you are in a voice match, on a room mic seat, or on a call, and never for advertising, profiling or listening to your surroundings. Audio and microphone features work only while the app is open, and stop when you move it to the background or close it. If you leave the app in the background, or are inactive, for about five minutes, your seat in a room goes to someone else who is listening.
16.9 Conduct standards apply to voice and video exactly as they apply to text. Everything in Section 12 is a violation whether it is typed, spoken or shown on camera.
16.10 Direct calls. You can call one other person directly, by voice or by video, from a conversation you are already in. In Guide Mode you can call someone you have matched with, and both of you must be verified under Section 21 before either of you can place or receive a call. In Butterfly Mode you can call someone once your conversation is open, which means once they have replied to your first message; Butterfly Mode does not require verification, because it does not ask you for identity documents at all.
16.11 What a direct call does and does not do. A call rings inside the app only. It is not a telephone call, it does not use your telephone number, it does not appear in your device's call history, and the other person does not learn your number from it. You can decline a call, and a decline tells the caller nothing beyond the fact that you declined. If you do not answer, the call ends by itself.
16.12 A video call also uses your camera. Video is optional and is chosen per call. A voice call does not turn your camera on, and you can turn your camera off during a video call. Your camera is used only for the duration of a call you are in.
16.13 Calls are not recorded. YoYo does not record or retain the audio or video of a direct call. Section 16.7 applies to calls exactly as it applies to rooms: you must not record, capture or re-stream the other person without their consent.
16.14 Limits. There is a daily limit on how many people one account may call, and you can be in only one call at a time. If the person you are calling is already on a call, your call will not connect until they are free.
17. AUTOMATED AND AI FEATURES
17.1 What is automated. Four parts of the Service use automated or AI systems:
- YoYo Date Coach: an advisor in Guide Mode powered by an OpenAI model, which gives dating and conversation suggestions. A single coaching session is capped at a set number of messages, and a daily limit applies across all of your sessions.
- Icebreakers in Butterfly Mode: a feature that proposes suggested chat openers, generated by OpenAI from the two users' interest tags and planets and the recent messages in that conversation. Suggestions are cached, rate-limited, filtered to strip contact details, and moderated. If you send a suggestion unchanged, the message is marked as AI-assisted.
- Automated moderation: described in Section 13.
- The reservation agent: described in Section 18. This one is not run by us and not run by OpenAI; read 18.2.
17.2 Output is machine-generated and may be wrong. AI output is generated by statistical models. It can be inaccurate, outdated, biased, inappropriate or simply bad advice. It is not professional advice of any kind, and it is not psychological, medical, legal or financial advice. Do not rely on it as a substitute for your own judgement.
17.3 You remain responsible. Anything you send, do or agree to is yours, even if an AI feature suggested it. Read a suggested opener before you send it. Check a reservation before you rely on it. Sending an AI-generated message does not transfer responsibility for that message to YoYo.
17.4 What we send to OpenAI. To provide these features we send: the text of your Date Coach messages, together with the earlier messages in that session so that the model has the context; the text and images of posts being screened; comments being screened; chat and party-room messages being screened, in both modes; party room titles; your display name, handle and profile bio; your profile photographs; date plan and Venue Board text; and, for icebreakers, the two users' interest tags and planets and the recent messages in that conversation. For images, what we send is the address of the image, and OpenAI fetches the image itself from our storage. The Privacy Policy sets out the detail.
17.5 Your Date Coach sessions are stored. A Date Coach session is stored on our servers with your account identifier, the messages you sent and the model's replies, so that the conversation continues where you left it and so that we can improve the feature. Sessions are deleted when you delete your account. Do not put anything into Date Coach that you would not want stored. Section 23.11 tells you something further about how those records are protected today, and you should read it.
17.6 No automated decision with legal effect. Automated screening can block a post, empty a message or hide content pending review. It does not suspend or terminate an account by itself: an enforcement decision of that kind is made by a person, and is reviewable on request under Section 30.4.
18. YOYO RESERVATIONS: WE ATTEMPT A BOOKING, WE DO NOT GUARANTEE ONE
Read this Section before you use the feature. It is the part of YoYo where the gap between what people assume and what actually happens is widest.
18.1 What YoYo Reservations is. When you ask YoYo to book a venue, we ATTEMPT to make a booking for you at that venue. That is the whole of what we do. A reservation made through YoYo is a request to an independent business that has no agreement with us and no obligation to us or to you. We do not hold tables, we do not hold inventory, we have no commercial relationship with the venues shown in the app, and we cannot make a venue accept you.
18.2 Who actually performs the attempt. An automated agent visits the venue's own public booking page and tries to complete the booking form on your behalf. That agent is not run on our servers: it is an AI-driven automated browser operated for us by Browser Use, Inc. (browser-use.com), a service provider in the United States. If the automated attempt cannot be completed, the attempt goes into a queue and a member of the YoYo team completes it by hand, usually by telephoning the venue.
18.3 What is submitted, named exactly. To complete a venue's booking form the agent submits: your first name, your last name, your full name as it appears on your account, a telephone number, an email address, the date, the time, the party size, and any special request. The special request is taken from the dietary preference saved on your Guide Mode profile. If you have recorded a food allergy, an intolerance, or a religious dietary requirement there, that information is included, it is sent to Browser Use, and the agent is instructed to enter it into the venue's allergy or special-requests field. The venue then holds it too. Allergy and religious dietary information is treated as sensitive under some laws, so we are naming it here rather than hiding it inside the phrase "special requests". If you do not want it sent, remove it from your profile before you make a booking.
18.4 The venue receives your details, and the venue is not our processor. The agent types your details into the venue's own booking site. The venue is an independent recipient. It handles what it receives under its own terms and its own privacy practices, which we do not control and are not responsible for.
18.5 A venue can refuse. A venue can refuse the booking, ignore it, fail to record it, cancel it afterwards, be closed, be full, have changed its policy, require a deposit we will not pay, or simply never respond. Any of these is a normal outcome and none of them is a failure of these Terms. We do not guarantee that a booking will be attempted successfully, that it will be accepted, that it will be honoured, that the venue will be open, or that the price, menu, opening hours or details shown in the app are current.
18.6 Nothing in the app is a confirmed reservation unless the venue confirms it. The app shows you the state of an attempt as it progresses. Until you have a confirmation from the venue itself, treat what you are looking at as a request, not a table. If the date matters to you, telephone the venue and confirm it yourself. We would rather you did that than trust the app.
18.7 You are appointing us to act for you. By using YoYo Reservations you authorise YoYo and its agent to submit the information in 18.3 to the venue in your name for the purpose of attempting the booking. You are responsible for the accuracy of what you give us and for making sure the other person on the date is content for their name to be included.
18.8 A person at YoYo may see your reservation. If a venue's booking site cannot be completed automatically, a member of the YoYo team completes the booking by hand and sees the reservation details, including the names, the telephone number, the email address, the date, the time and any note you wrote. An automated email also tells our team that a booking needs a person, and that email contains the guest name and the account email address. Do not put anything in a reservation note that you would not want a person at YoYo, and a person at the venue, to read.
18.9 No payments. The agent is instructed never to enter payment-card details and to stop if a venue requires a card, a deposit or a prepayment, in which case the attempt ends and we tell you. YoYo does not take payment for a reservation and does not hold your card details.
18.10 Changes and cancellations. If you change or cancel a booking in the app, we attempt the change with the venue in the same way, with the same limits. Do not rely on it. Cancel with the venue directly as well, using the venue's own cancellation route, and do it in good time.
18.11 Your obligations to the venue. If a booking is made for you, you are the venue's customer. Turn up, or cancel in good time. Repeated no-shows harm the venue, harm the other user, and harm YoYo's ability to offer the feature, and may lead us to withdraw access to YoYo Reservations from your account. You are responsible for anything you owe the venue, including any cancellation or no-show charge the venue imposes. YoYo is not liable for a charge a venue makes to you.
18.12 We record attempts. Reservation attempts, successful and unsuccessful, are recorded so that we can support you, avoid duplicate bookings and improve the feature. Section 31 explains what happens to those records when you delete your account.
19. MEETING PEOPLE IN PERSON: RISK AND SAFETY
19.1 The core warning. Guide Mode exists to help you meet strangers in person. Meeting a stranger carries real risk. YoYo does not conduct criminal-background checks, sex-offender-registry checks, employment checks, or identity investigations on its users, and we do not intend to imply otherwise anywhere in the app. Nothing in the Service is a substitute for your own caution.
19.2 What verification does not prove. ID verification (Section 21) means a person at YoYo has looked at a photograph of a document and formed the view that it appears to show a real adult. It does not prove that the person is who the document says, that the document is genuine, that the account is operated by the person in the document, or anything at all about that person's character, criminal history, marital status, employment, health or intentions. A verified badge is not a safety guarantee and must never be read as one. An unverified account is not necessarily dangerous, and a verified one is not necessarily safe.
19.3 You meet at your own risk. You alone decide whether to meet someone, where, when, and what to do. YoYo is not a party to your meeting, does not supervise it, does not accompany it, and is not responsible for the conduct of other users before, during or after it, whether online or offline.
19.4 Practical safety guidance, which we ask you to follow:
- Video or voice chat inside the app before you meet.
- Meet the first few times in a public place with other people around, and stay in public.
- Arrange your own transport there and back. Do not accept a lift from someone you have just met, and do not let anyone take you to a private location.
- Tell a friend or family member where you are going, who with, and when you expect to be back. Share your live location with them.
- Keep your phone charged, and keep your drink with you.
- Do not send money to anyone you have met on YoYo. There is no genuine reason for someone you have not met to need your money.
- Do not share your home address, your workplace, your financial details, your identification documents or your account passwords.
- Trust your instincts and leave whenever you want. You do not owe anyone an explanation.
- If something goes wrong, contact local emergency services first, then report the user to us.
19.5 Location, stated exactly. Proximity features use your device location with your permission, which you can revoke at any time in your device settings. Revoking it limits distance-based matching and venue discovery; the rest of the Service keeps working. Understand how it works before you grant it:
- We read your location only while the app is open and in use. The app does not have background location permission and does not follow you when it is closed.
- The coordinates last reported by your device are stored on your account record, and the app running on other users' devices reads them in order to work out how far away you are.
- We also convert your coordinates into a city and a country. On an iPhone that conversion is performed by Apple's own geocoder, which receives the raw coordinates to do it.
- Your coordinates are also sent to Google's Places and Maps services, directly from your device, when the app looks for venues near you.
- YoYo does not publish a map pin of you and does not show other users your address. But a signed-in user who has not matched with you can, through the app, tell roughly where you are. If you would rather that did not happen, turn location off for YoYo in your device settings.
19.6 What else other users can read. Read Section 23.11. It states, without softening, which parts of your account record are readable today by other signed-in users of the app. It is the single most important thing on this page for deciding what to put on your profile.
19.7 Off-platform contact. If you move a conversation to another app, a phone number or a messaging service, everything in these Terms about moderation, reporting and blocking stops applying, because we can no longer see it and no longer have any control over it. We cannot help you with something that happened somewhere else, beyond acting on the YoYo account.
20. DEVICE PERMISSIONS
20.1 The Service asks for the following device permissions, each optional, each revocable in your device settings, and each used only for the stated purpose:
- Location: proximity-based matching and map-based venue discovery in Guide Mode. Requested for use while the app is open only.
- Photos and camera: choosing or taking profile photographs, posting images and video to the Square, sending a photograph or an animated image inside a chat, and photographing an identification document if you choose ID verification. Your camera is also used during a video call, and only for the duration of that call.
- Microphone: voice matches and party rooms in Butterfly Mode, and direct voice and video calls in both modes.
- Nearby devices, on Android only: routing party-room and voice-match audio to a paired Bluetooth headset or speaker. It is not used to scan for, identify or record nearby devices, and it is not used to work out where you are.
- Calendar: reading your device calendar events so that your YoYo plans appear alongside your existing commitments, and writing an accepted date into your device calendar. Section 6.4 explains the write in full.
- Notifications: push notifications about matches, messages, reservations and Butterfly Mode activity. You can turn push off and still receive in-app notification rows in Butterfly Mode.
20.2 Refusing a permission does not prevent you from using the Service; it disables the feature that needs it.
20.3 A note on push notification content. A Guide Mode push notification about a new message includes the first part of that message in the notification text, so it can appear on your lock screen and it passes through our push relay provider and through Apple's or Google's push service on the way to you. Butterfly Mode push notifications do not contain message text. If you do not want message previews on your lock screen, turn previews off in your device notification settings.
20.4 YoYo does not track you across other companies' apps and websites, and does not use any advertising or attribution software development kit.
21. VERIFICATION AND THE VERIFIED BADGE
21.1 ID verification is optional. If you choose it, you photograph an identification document and upload it to us. A person at YoYo reviews the submission and either approves or rejects it. If we approve it, your account receives verified status.
21.2 What it gates. Verification is not required to use the Service. The features gated on it today are: accepting a pending date invitation, using Quick Date, and creating a party room in Butterfly Mode.
21.3 What verification means, and what it does not. See Section 19.2. In short: it means a person looked at a document that appears to show that the account holder is a real adult. It is not a background check, not an identity investigation, and not a safety guarantee.
21.4 One verification, and where it shows. Verified status is set on your Guide Mode account. The same status is what allows you to create a party room in Butterfly Mode. Butterfly Mode does not display a verified badge today. Your identification document and your Guide Mode identity are never shown in Butterfly Mode. Anonymous posts never carry a verified badge.
21.5 Your document is never shown to other users. It is collected only to check that the account holder is a real adult person, it is stored separately from your profile photographs, it is readable only by you and by our reviewers, and it is never displayed anywhere in the app.
21.6 Who is told that you submitted one. When you submit a document, an automated email tells the YoYo team that a submission is waiting for review. That email contains your display name, the email address on your account and your account identifier. It does not contain the image of your document. The email is sent through our email provider and sits in our team's mailboxes.
21.7 How long we keep it. Your verification record and the document image are held while your account exists and are deleted when you delete your account, from both our database and our file storage. You can also ask us to delete the image sooner, at support@yoyodatingapp.com, though doing so may remove your verified status.
21.8 No facial recognition, no biometrics. We do not run facial recognition against your identification document or against any photograph you upload. We do not collect, capture, purchase, receive through trade or otherwise obtain a scan of your face or hand geometry, a voiceprint, a retina or iris scan, or a fingerprint, and we do not create, store, match, disclose, redisclose, disseminate, sell, lease, trade or otherwise profit from any biometric identifier or biometric information, as those terms are used in the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier Act and the Washington biometric-privacy statute. We hold no such information about you, because we never generate it. If we ever change this, we will obtain your separate written consent before collecting anything, publish a written retention and destruction schedule, and change this Section before the change takes effect.
21.9 Submitting a forged, altered or borrowed identification document is a serious violation and will result in permanent termination, and may be reported to the authorities.
22. FEES AND PAYMENTS
22.1 The Service is free of charge today. There is no subscription, no paid tier, no in-app purchase, no virtual currency, no gifting and no paid boost, in either mode. YoYo does not process payments, does not use a payment processor, and does not collect or store payment-card details. Any screen in the app that refers to saving a payment card is a preview of a feature that is not live and does nothing.
22.2 If we introduce paid features in the future, we will tell you at least 30 days before they take effect by in-app notice and, where we have your email address, by email. Paid features will never be applied retroactively to something you have already used, no charge will be made without your express, separate consent at the time, and continuing to use the free parts of the Service will never by itself create a payment obligation.
22.3 Any purchase made in future through the App Store or Google Play would be processed by Apple or Google under their terms, and refunds for such purchases would be handled by them under their policies.
22.4 Butterfly Mode points and levels have no monetary value and are not property, credit or currency. See Section 8.11.
22.5 Reservations are free. We do not charge you for a reservation attempt and we do not take a commission from a venue for it. What you owe the venue is between you and the venue.
23. PRIVACY, DATA AND CROSS-BORDER TRANSFER
23.1 The Privacy Policy, available in the app under Settings and forming part of these Terms, describes what personal information we collect, why, who we disclose it to, how long we keep it, and the rights you have, including rights under the California Consumer Privacy Act as amended, other United States state privacy laws, and Japan's Act on the Protection of Personal Information. Where this Section and the Privacy Policy differ in detail, the Privacy Policy governs.
23.2 Where your data lives. Our database is hosted in the United States, the files you upload are stored in Japan, and our server-side functions run in Taiwan. If you are in Japan, your personal information is stored in the United States and in Japan, is processed in the United States and in Taiwan, and is handled by YoYo LLC and by the providers listed in Section 24. The United States does not have a single national data-protection law equivalent to Japan's Act on the Protection of Personal Information; protection is provided through a combination of federal and state laws, sector-specific rules, and enforcement by the Federal Trade Commission and state attorneys general. We put contractual data-protection commitments in place with each provider. The Privacy Policy sets out the recipients, the countries, the regimes and the safeguards in the detail that Japanese law requires.
23.3 Information your device sends to outside parties. As required by Japan's Telecommunications Business Act external transmission rules, we tell you here which outside parties the app causes your device to transmit information to, and why. The Privacy Policy gives the full detail.
- Google Firebase (Authentication, Firestore, Cloud Storage, Cloud Functions, App Check, Cloud Messaging): your account identifier, the content you create, media you upload, device and app attestation signals, and configuration requests, in order to run your account, store and deliver the Service, and detect abuse.
- Google Analytics for Firebase: app-event information, an app-instance identifier, basic device and app information, and, on many events, your account identifier as an event parameter. We use this for product analytics only: we do not run advertising in the app, we use no advertising or attribution software development kit, and we do not sell this information or share it for cross-context behavioural advertising. Google provides this analytics service to us and handles the information it receives in accordance with the Google Privacy Policy.
- Google Maps and Google Places: your coordinates and your search terms, sent directly from your device, in order to show maps, find venues near you and retrieve venue details, photographs and reviews.
- Apple: your sign-in request if you use Sign in with Apple; push delivery through the Apple Push Notification service; and, on iOS, the raw coordinates that Apple's geocoder receives in order to turn them into a city and a country.
- Firebase Cloud Messaging and Expo: your device push token and the contents of a notification, including its title and body, in order to deliver push notifications. Expo relays the notification to Apple's and Google's push services, which means that the text of a Guide Mode message preview passes through Expo on its way to your device.
- OpenAI: the content described in Section 17.4, in order to moderate content and to generate Date Coach replies and icebreakers. For images, OpenAI is given the address of the image and fetches the image itself from our storage.
- Agora: the live audio, channel identifier and connection data of a voice match or party room, as described in Section 16.6.
- Crash and error diagnostics: when the app hits an error, it reports the error to our own servers with your account identifier, the screen you were on, your device model and operating system version, the app version and build, a session identifier, the error message and a short trail of the actions immediately before it. This goes to our own systems, not to a third-party crash service.
The following are sent by our servers rather than by your device, and only in the circumstances described:
- Browser Use, Inc.: when you ask us to attempt a booking - the information listed in Section 18.3, including any allergy or religious dietary note.
- Resend: our transactional email provider, which delivers automated alerts to the YoYo team. Two of those alerts contain your information: an ID-verification submission alert containing your display name, account email address and account identifier (Section 21.6), and a reservation alert containing the guest name and account email address when a booking needs a person (Section 18.8). Those emails also sit in the mailboxes of the YoYo staff who receive them.
- The venue you chose, when you use YoYo Reservations, as Section 18.4 explains. The venue is an independent recipient.
23.4 What you can and cannot switch off. You can stop most of these transmissions by not using the feature that causes them, by revoking the relevant device permission, or by deleting your account. Push notifications can be turned off, and that preference is honoured on our servers before anything is sent to you.
Two things you cannot switch off today, and we would rather say so than offer you a control that does not exist:
- Analytics. Analytics collection is switched on when the app starts and there is no setting, toggle or consent prompt in the app to turn it off. If you do not want it, the only route today is to delete your account and remove the app. We are adding a control; until this Section says otherwise, there is not one.
- Moderation. Content screening is not optional, by design. You cannot opt out of having your content screened, and an account that could would be a hole in everyone else's protection.
23.5 We do not sell your personal information, and we do not share it for cross-context behavioural advertising. We have not done so at any time in the preceding twelve months. We do not use or disclose sensitive personal information for purposes beyond those permitted without a right to limit under California law. There is no advertising network, no attribution software development kit and no data broker anywhere in the app.
23.6 Your privacy rights. The Privacy Policy contains our notice at collection: the categories of personal information we collect, where we get it, why we collect it, the categories of third parties we disclose it to, and how long we keep each category. Depending on where you live you have some or all of the following:
- the right to know what personal information we have collected about you, the categories of sources it came from, the business purposes we collected it for, the categories of third parties we disclose it to, and the specific pieces of personal information we hold about you;
- the right to receive a copy of that information in a portable and, where technically feasible, readily usable format;
- the right to have it deleted;
- the right to have inaccurate personal information corrected;
- the right to opt out of the sale of your personal information, of sharing it for cross-context behavioural advertising, and of processing it for targeted advertising. We do none of those things, so there is nothing for you to opt out of, but the right stays available to you and we will confirm our position in writing if you ask;
- the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. We do not carry out profiling of that kind, as Section 17.6 explains;
- the right to limit our use and disclosure of sensitive personal information. The information we treat as sensitive is your precise geolocation, the identification document you submit if you choose verification, any allergy or religious dietary note on your profile, and the profile attributes that reveal sexual orientation, religion or political leaning. We use and disclose these only for the purposes permitted without a right to limit under California law: providing the features you asked us for, keeping the Service and your account secure, detecting and acting on abuse, fraud and illegal activity, and meeting legal obligations. We do not use them to infer characteristics about you, and we do not disclose them for any advertising purpose; and
- the right not to be discriminated against or retaliated against for exercising any of these rights. We will not deny you the Service, degrade it, charge you a different price, or give you a different level or quality of service because you exercised a privacy right.
23.7 Correcting and exporting, stated honestly. You can correct almost everything yourself: every Guide Mode profile field is editable in the app, and in Butterfly Mode you can change your avatar, your planet and your tags, and retake the quiz once every seven days. Two things you cannot change yourself are your Butterfly handle, which is permanent (Section 8.2), and your verified status, which only we can set.
There is no self-service data export in the app today. There is no download-my-data button and no export file, and we are not going to describe one that does not exist. If you want a copy of your data, email support@yoyodatingapp.com with the subject line PRIVACY and we will assemble it by hand and send it to you within the deadlines in 23.9. We are building a self-service export; until this Section says otherwise, the email route is the route.
23.8 How to exercise a right. Email support@yoyodatingapp.com with the subject line PRIVACY and tell us which right you want to exercise. You can also delete your account, and with it most of your personal information, from inside the app at any time, as Section 31 describes. Making a privacy request costs nothing.
23.9 Our deadlines. We acknowledge a privacy request within 10 business days of receiving it and we respond within 45 calendar days. If we need longer, we will tell you within that first 45-day period, with the reason, and take up to a further 45 days, so never more than 90 days in total. We do not charge for a response. If a request is manifestly unfounded or excessive, in particular because it is repetitive, we may charge a reasonable fee or refuse to act, and if we do either we will tell you why first and tell you how to appeal.
23.10 How we verify that a request is really from you, authorised agents, and appeals.
- Verification. Before we act on a request to know, delete, correct or export, we have to be reasonably sure the request comes from you, because acting on a false request would expose your data to someone else. We will normally ask you to send the request from the email address on your account, and to confirm one or more pieces of information we already hold, such as the sign-in provider you use or the approximate date you created the account. For a request seeking the specific pieces of personal information we hold, rather than categories, we apply a higher standard and may ask you to confirm further details or to make a signed declaration under penalty of perjury that you are the person the information is about. We will not ask you for a photograph of an identification document in order to verify a privacy request, and anything you send us for verification is used only to verify you and is then deleted. If we cannot verify you, we will tell you why and, where the law permits, treat the request as a request about categories of information rather than specific pieces.
- Authorised agents. You may use an authorised agent to make a request for you. We will ask the agent to give us written permission signed by you, and we may ask you to confirm directly with us that you gave that permission and to verify your own identity, unless the agent holds a valid power of attorney under the probate law of your state.
- Appeals. If we refuse a privacy request in whole or in part, we will tell you the reason. You may appeal by emailing support@yoyodatingapp.com with the subject line PRIVACY APPEAL within 60 days of our decision. Someone who was not responsible for the original decision will review it, and we will tell you the outcome in writing, with our reasons, within 45 days. If we deny the appeal we will also give you a method of contacting the attorney general of your state. In California you may in addition contact the California Privacy Protection Agency; in Japan you may contact the Personal Information Protection Commission. This appeal is separate from the appeal against an enforcement decision in Section 30.4.
23.11 The limits of our access controls today, stated without softening. We would rather you decided what to put in the app knowing this than find it out later.
- Your account record is readable by other signed-in users. The record that holds your Guide Mode profile also holds your date of birth, the telephone number you saved, the email address on your account and your last reported coordinates, and the app's data rules currently allow any signed-in YoYo user to read another user's account record. The app's own screens do not show those fields to other users, but the rule that would stop a modified client from reading them is not in place yet. Assume that anything on your account record can be read by another user of the app.
- Some older records are on a permissive rule. A number of collections created earlier in the app's life - date plans, matches, notifications, reservations and feedback - are still governed by a legacy rule that allows any signed-in user to read and write them. This is being changed collection by collection.
- Our anti-abuse attestation is not being enforced yet. The app sends an attestation signal that lets us tell a genuine copy of the app from something else. We are collecting it and watching it, but we are not yet rejecting requests that fail it.
- What is properly protected. The private record of who wrote an anonymous post, and the mapping between your account and your Butterfly identity, are readable by no client at all, in either direction, and never have been. Government identification documents are readable only by you and by our reviewers. Chats are readable only by their participants. Crash reports cannot be read back by anyone, including the person who sent one.
We are tightening the rest, and we will amend this Section as each one is done rather than quietly deleting it. If any of this changes your mind about the app, delete your account; Section 31 tells you exactly what that does.
24. THIRD-PARTY SERVICES AND PROCESSORS
24.1 The Service depends on these third parties, and their terms apply to their part of what you do:
- Google Firebase and Google Cloud, for authentication, database, media storage, backend functions, analytics, push messaging and anti-abuse attestation.
- Google Maps and Google Places, for venue discovery and venue detail. Your use of the mapping features is also subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
- OpenAI, for automated moderation, the YoYo Date Coach and icebreakers.
- Agora, for real-time voice transport.
- Apple, for Sign in with Apple, push delivery, on-device calendar access and, on iOS, turning coordinates into a place name.
- Browser Use, Inc., for the AI-driven automated browser that attempts venue booking forms when you use YoYo Reservations.
- Resend, for the automated emails that alert the YoYo team, as described in Sections 18.8, 21.6 and 23.3.
- Expo and React Native, as the app runtime, including media picking and compression, over-the-air app updates, and the relay of push notifications to Apple's and Google's push services.
- The venues you choose to attempt a booking with, which receive your booking details through their own public booking sites or by telephone and handle them under their own terms and privacy practices.
24.2 We do not control these services, and we are not responsible for their content, availability or practices. Links and venue information shown in the app are provided for convenience and are not an endorsement.
24.3 Our own people. Some parts of the Service are performed by people at YoYo rather than by software: reviewing identification documents, reviewing reports, and completing a reservation by hand when the automated attempt fails. Sections 18.8 and 21.1 say where that happens.
24.4 We do not run advertising in the app. We use no advertising network, no attribution or tracking software development kit, no data broker, and no payment processor, and we do not track you across other companies' apps and websites.
25. OUR INTELLECTUAL PROPERTY, AND YOUR LICENCE TO USE THE APP
25.1 YoYo and its licensors own the app, the Service, and everything in them other than Your Content and other users' content: the software, the design, the interface, the avatars, the planets, the YoYo name and logo, and all associated intellectual property rights.
25.2 Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-sublicensable, non-transferable, revocable licence to download and use one copy of the app on a device you own or control, for your own personal, non-commercial use. Section 26 adds the terms that apply to copies obtained from the Apple App Store.
25.3 You may not copy, modify, adapt, translate, create derivative works from, distribute, licence, sell, lease, or publicly display the app or any part of it, remove any proprietary notice, or use our name or logo without written permission.
25.4 All rights not expressly granted are reserved.
26. TERMS THAT APPLY TO THE APPLE APP STORE VERSION
This Section applies if you obtained the app from the Apple App Store, and, as between these Terms and Apple's standard licence terms, this Section is the licence terms for the app.
26.1 This agreement is between you and YoYo only, and not with Apple. Apple is not a party to it. YoYo, not Apple, is solely responsible for the app and its content.
26.2 Scope of licence. The licence granted to you for the app is a non-transferable licence to use the app on any Apple-branded product that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where Apple makes those available.
26.3 Maintenance and support. YoYo is solely responsible for providing any maintenance and support services for the app. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
26.4 Warranty. YoYo is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be YoYo's sole responsibility.
26.5 Product claims. YoYo, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation, including in connection with the app's use of any framework for health and fitness data (the app does not use such frameworks).
26.6 Intellectual property claims. In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, YoYo, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
26.7 Legal compliance. You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
26.8 Developer name and address. Questions, complaints and claims about the app should be directed to: YoYo LLC, 453 S Spring St STE 400 PMB1290, Los Angeles, CA 90013, United States, or YoYo KK, Ltd., 566 Tensho Office Hamamatsucho Daimon, Eagle Hamamatsucho, 2-7-17 Hamamatsucho, Minato-ku, Tokyo 105-0013, Japan. 26.9 Third-party terms. You must comply with any applicable third-party terms of agreement when using the app, including the terms of the services listed in Section 24 and the terms of your wireless data plan.
26.10 Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary of them.
27. TERMS THAT APPLY TO THE GOOGLE PLAY VERSION
27.1 If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app.
27.2 Deleting your account from outside the app. You can delete your account from inside the app at any time, as Section 31.1 describes. You can also request deletion without installing or opening the app, by emailing support@yoyodatingapp.com with the subject line DELETE ACCOUNT, from the address associated with your account or giving us enough information to identify it. We acknowledge that request within 3 business days, verify that it comes from the account holder, and complete the deletion within 30 days of verifying you, sooner where we can. There is no partial deletion and no deactivate-only option.
28. COPYRIGHT AND RIGHTS-INFRINGEMENT NOTICES (UNITED STATES, DMCA)
28.1 We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. section 512.
28.2 Designated agent. YoYo LLC has designated an agent to receive notifications of claimed infringement. Send notices to: Copyright Agent, YoYo LLC, 453 S Spring St STE 400 PMB1290, Los Angeles, CA 90013, United States. Email: support@yoyodatingapp.com with the subject line DMCA NOTICE. Email is the fastest route and is the one we prefer.
28.3 What a valid notice must contain:
- a physical or electronic signature of the owner of the exclusive right allegedly infringed, or of a person authorised to act on the owner's behalf;
- identification of the copyrighted work claimed to have been infringed, or a representative list if there are several works at one site;
- identification of the material that is claimed to be infringing and that is to be removed, with enough information to let us locate it. For a Square post this means the date and time you saw it and a screenshot, plus the handle shown if the post has one. A post published anonymously shows no handle; tell us the date, the time and what the post contained, and send a screenshot, and we will find it;
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use complained of is not authorised by the copyright owner, its agent, or the law; and
- a statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the owner of the exclusive right allegedly infringed.
A notice that omits these elements may not be effective. Misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. section 512(f).
28.4 What we do. If a notice is substantially complete we will remove or disable access to the material expeditiously and notify the user who posted it, passing on a copy of the notice.
28.5 Counter-notification. If your material was removed and you believe it was removed by mistake or misidentification, you may send a counter-notification to the same address containing: your signature; identification of the material and the location where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which YoYo LLC may be found, which includes the Central District of California), and that you will accept service of process from the person who gave the original notice or that person's agent. Read Section 28.8 before you send a counter-notification about a post you published anonymously. We will forward the counter-notification to the person who filed the original notice, and unless that person tells us within ten business days that they have filed an action seeking a court order to restrain the activity, we may restore the material within ten to fourteen business days.
28.6 Repeat infringers. We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. As a general rule, an account that is the subject of three substantiated infringement notices without a successful counter-notification will be terminated, and we may terminate sooner where the infringement is flagrant.
28.7 Other rights. Notices about trademark, publicity, defamation, privacy or other rights should also be sent to support@yoyodatingapp.com with a description of the right, the content complained of, and why it infringes.
28.8 Anonymous posts, and what a counter-notification costs you. A notice under this Section can name a post that was published without a visible author, and we can act on it. Our servers hold a private record of who wrote every anonymous post, as Section 10.2 explains, and we use it to remove the post and to notify its author. You do not need to know who wrote a post in order to send us a valid notice.
If you are the author of an anonymous post that we have removed, understand this before you do anything. A counter-notification under Section 28.5 must, by law, contain your real name, your address and your telephone number, and the law requires us to send the whole counter-notification, including those details, to the person who sent the original notice. Sending a counter-notification therefore ends your anonymity as to that person, permanently, and we cannot undo it or redact it. If you do not want your identity disclosed to the complainant, do not send a counter-notification. The post stays down and nothing else happens to your account.
We do not disclose the author of an anonymous post to a complainant, or to any other private party, in any other circumstance. Outside the counter-notification route, we disclose it only under a legally valid order, or as Section 29.6 describes for Japanese sender-information disclosure requests.
29. RIGHTS-INFRINGEMENT REMOVAL REQUESTS UNDER JAPANESE LAW
29.1 If information published on YoYo infringes your rights, including defamation, invasion of privacy, breach of portrait rights or copyright infringement, you may request its removal, whether or not you are a YoYo user. This procedure is published in accordance with Japan's provider-liability framework and the Act on Countermeasures against the Distribution of Information on Specified Telecommunications Platforms.
29.2 Where to send a request. support@yoyodatingapp.com, with the subject line 権利侵害の申告 or RIGHTS INFRINGEMENT. You may write in Japanese. Postal requests may be sent to YoYo KK, Ltd., 566 Tensho Office Hamamatsucho Daimon, Eagle Hamamatsucho, 2-7-17 Hamamatsucho, Minato-ku, Tokyo 105-0013, Japan.
29.3 What a request must contain:
- your name and contact details (email address, and postal address if you are writing by post), and, if you are acting as an agent or lawyer, the name of the person you act for;
- the location of the information, described precisely enough for us to find it: the mode, the screen, the handle shown, and the date and time it was seen, with a screenshot if possible;
- the part of the information that infringes your rights, quoted;
- the right that is infringed and the reason it is infringed, in concrete terms; and
- a statement that the contents of the request are true.
29.4 How we respond. We acknowledge receipt, and we notify you of our decision on the request, in principle within 14 days of receiving a complete request. Requests involving an immediate risk to safety, non-consensual intimate imagery, or child safety are handled immediately.
29.5 Notification of the poster. In deciding a request we may send the substance of the request to the person who posted the information and ask whether they consent to its removal. We will not disclose your contact details to them without your permission unless we are legally required to. If the poster does not object within a reasonable period, we may remove the information.
29.6 Disclosure of sender information. Requests for disclosure of a sender's information are handled in accordance with the applicable Japanese statutory procedure. We do not disclose a user's identity to another private party without a legally valid basis, including a court order.
29.7 Nothing in this Section limits the DMCA procedure in Section 28, and nothing in Section 28 limits this one.
30. SUSPENSION, TERMINATION AND APPEALS
30.1 Your right to leave. You may stop using the Service at any time, and you may delete your account at any time. Section 31 explains how, and exactly what deletion does.
30.2 Our right to act. We may warn you, remove or hide content, restrict or disable a feature, suspend your account, or terminate your account and these Terms, if:
- you breach these Terms or the Community Standards in Section 12;
- we reasonably believe your conduct puts another person, YoYo, or a third party at risk of harm or legal liability;
- you are the subject of substantiated reports;
- you are under 18 or otherwise ineligible under Section 3;
- you evade a previous enforcement action; or
- we are required to act by law, by a court, or by a platform rule.
An enforcement action may be limited to one mode - for example, suspending Butterfly Mode while Guide Mode keeps working - or applied to the whole account, depending on what happened and how serious it was.
30.3 Notice. Except where the violation is severe (including anything in Section 12.1, credible threats, non-consensual intimate imagery, or fraud), where notice would let you frustrate the action, or where the law prevents it, we will tell you what happened and why.
30.4 Appeals. If you believe an enforcement decision was wrong, email support@yoyodatingapp.com with the subject line APPEAL within 30 days, explaining why. A person who was not responsible for the original decision will review it, and we will normally respond within 14 days. Decisions under Section 12.1 (child safety) are not appealable. If your appeal concerns a privacy request rather than an enforcement action, use the process in Section 23.10 instead.
30.5 What a suspension does. A suspended account keeps its data. You cannot sign in or be seen by other users while it lasts. If a suspension becomes a termination we will tell you, and Section 31 then describes what happens to your data.
30.6 Effect of termination. When these Terms end, your licence to use the app ends and you must stop using it. Sections 10.2, 11.6, 11.8, 22.4, 23, 25, 26, 28, 29, 31, 32, 33, 34, 35, 36, 37 and 40 survive termination, together with any other provision that by its nature should survive.
30.7 No compensation. Because the Service is free, termination or suspension does not create a right to a refund or to compensation, except where a mandatory consumer law provides otherwise.
31. DELETING YOUR ACCOUNT, AND EXACTLY WHAT IT DOES
31.1 How to delete. In Guide Mode, open Settings and choose account deletion. In Butterfly Mode, open the far-right tab, the one showing your avatar, then Settings, then Delete Account. Both routes run the same deletion, and both delete both modes. There is also a deletion page on our website, and the email route in Section 27.2. Deletion is permanent and cannot be undone. We cannot restore a deleted account or its content, and if you come back you start again from nothing.
31.2 How quickly it happens. Deletion begins immediately. It runs as a sequence of steps across both modes, and it is normally finished within a minute or two. If a step does not complete - because a service was briefly unavailable, for example - a scheduled process running every half hour picks up what was left and finishes it. So the accurate statement is: we begin immediately, and a scheduled process completes anything the first pass could not. If you want written confirmation that your deletion completed, ask us at support@yoyodatingapp.com and we will check and tell you.
31.3 What is removed from our live systems. From Guide Mode: your profile and your photographs, including the untouched originals held alongside the displayed versions; your chats and every message in them, together with files you attached; your matches; your reservations and reservation attempts; your date plans that were yours alone; your YoYo Calendar entries; your saved venue Collections; your saved plans; your Date Coach sessions; your identification-verification record and the document image itself, from both the database and file storage; your notifications; your activity records; your feedback; your error records; your location history; and the record of your account itself.
From Butterfly Mode: your profile and handle; the Square posts you published under your handle and the posts you published anonymously, with their comments and likes; your comments on other people's posts; your likes; your following and follower relationships in both directions; your Butterfly notifications, including notifications about you sitting on other people's screens; your Butterfly conversations with their messages and the stored icebreaker suggestions inside them; the party rooms you hosted; your messages in other people's rooms, including the permanent rooms that never close; your membership of other people's rooms; moderator powers you were given in other people's rooms; your voice-match records; your matchmaking queue entries, results, pair cooldowns and quota counters; the pairing log that recorded who you were matched with; the dust wipes you sent; all Butterfly media in our storage; and the mapping between your account and your Butterfly identity.
To find and erase the posts you published anonymously we use the private authorship record described in Section 10.2, and we re-run that search at the end to confirm nothing is left pointing at you. That is the one place where we use that record to erase rather than to enforce.
31.4 Your Butterfly profile goes dark first. Before anything is deleted, your Butterfly profile is flagged so that it stops appearing to other users and stops entering matchmaking, and any live room you were hosting is closed. That way you are out of sight within moments even while the rest of the deletion is still running.
31.5 Your deletion reason. If you choose a reason when you delete, that reason is recorded as an analytics event. It is not stored against your account and it is not attached to your identity in our database.
31.6 What is kept, and why. Some things do not go, and we would rather tell you than have you find out.
- Reports are kept, in both directions. A report about your account, and a report you filed about someone else, are retained after deletion and flagged to show that the account has gone, so that a person who has been reported cannot erase the record of what they were reported for by deleting themselves. We keep reports to detect security incidents and to protect against malicious, deceptive, fraudulent or illegal activity, which California law expressly permits as an exception to the right of deletion under Civil Code section 1798.105(d), and, for users in Japan, because the Act on the Protection of Personal Information permits retention necessary to protect the life, body or property of a person. Moderation decisions, suspensions, terminations and legal notices are kept on the same basis.
- A retained report can contain what you wrote. This is the part that is easy to miss, so we are stating it separately. When automated moderation removes or empties a message, the safety record it creates contains a copy of that message - for a chat message, up to its first 1,500 characters. That record is a report, so it is retained under the paragraph above. The consequence is that the text of a message of yours that was blocked can survive the deletion of your account inside a safety record. "We keep the report" and "we keep what you wrote" are different promises, and we are making the second one honestly.
- Blocks placed against you are kept, so that they keep protecting the person who placed them after you leave. For the same reason, if another user has hidden or blocked you, your identifier stays on their list. We are not going to edit a survivor's protection to tidy up after the person they were protected from.
- Shared date plans are kept, and here we are correcting what an earlier version of these Terms said. A date plan that was yours alone is deleted with your account. A plan you shared with another person is kept, because it also sits in that person's chat and calendar, and it is flagged to record that one of its participants has deleted their account. Your account identifier stays on the plan; nothing strips it. What happens is that the identifier stops resolving to anything, because the account record it pointed at is gone, so nobody can look you up from it. That is the accurate description, and it is not the same as saying your name has been removed.
- A booking that names you but belongs to someone else is kept for them, with the pointer to you removed.
- Bans and mutes you collected in other people's rooms are kept, so a host's decision is not undone by your leaving.
- Your handle and avatar can survive on another user's notification, where they were copied in at the time. Those rows carry no identifier and age out.
- A reservation still in progress is not deleted; it is cancelled and the customer details on it are blanked. Reservations already finished or already cancelled are deleted.
- Crash and error diagnostics are not reached by deletion today. Our crash reporting stores samples of recent errors, and a sample can include your account identifier, the screen you were on, your device model and app version, a session identifier and a short trail of the actions before the error. Account deletion does not currently remove those samples and there is no scheduled process that ages them out. We are adding one. Until then, email support@yoyodatingapp.com and ask us to purge your crash samples and we will do it by hand and confirm.
- Analytics events already sent are not reached by deletion. Events your app has already sent to Google Analytics for Firebase, some of which carry your account identifier, sit with that service under its own retention setting. Deleting your account does not delete them.
- Server logs and staff email are not reached by deletion. Our operational logs, and the alert emails described in Sections 18.8 and 21.6 that are already sitting in our team's mailboxes and with our email provider, are governed by their own retention rather than by the deletion process.
- A booking task already submitted to our booking agent is not reached by deletion.
- Content already delivered to other people stays with them. Messages the other participant still holds, and anything another user has saved, screenshotted, quoted or re-shared, is outside our control and outside the reach of a deletion.
- Backups take time to cycle out. Deleted data can persist in backup copies for a limited period before it is overwritten; residual copies are gone within 90 days.
- Housekeeping is not instant. Some uploaded media is erased by a sweep rather than at the instant of deletion, so a file can remain in our storage for up to about a day. Party-room state clears on the next maintenance pass.
31.7 Deleting individual items. If you want to delete individual posts, comments, photographs, plans or Collections without deleting your account, you can do that at any time inside the app.
31.8 If you want anything in 31.6 removed. Ask us. Where the law gives you the right and no exception applies, we will do it and tell you we have. Where an exception applies - a safety record, most often - we will tell you which one and why.
32. DISCLAIMERS
32.1 To the maximum extent permitted by applicable law, and subject to Section 32.5, the Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express, implied and statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty arising from course of dealing or usage of trade.
32.2 Without limiting Section 32.1, we do not warrant that the Service will be uninterrupted, timely, secure or error-free; that defects will be corrected; that matches, suggestions, moderation, screening or reservation attempts will be accurate, complete or successful; that any reservation will be made, accepted or honoured; that content posted by other users is truthful, lawful or safe; that another user is who they claim to be; that another user is 18 or over; or that any meeting, relationship or outcome will result from your use of the Service.
32.3 YoYo does not conduct criminal-background or sex-offender-registry checks on users. We are not a matchmaking, introduction, escort or chaperone service, we are not a booking agency, and we are not a party to any interaction between users or between you and a venue.
32.4 Venue information shown in the app comes from third-party mapping services and from other users, and we do not warrant that it is accurate, current or complete.
32.5 Japanese consumers - carve-out. If you are a consumer and your contract is with YoYo KK, Ltd., nothing in this Section excludes or limits our liability where such exclusion or limitation is void under the Consumer Contract Act of Japan or any other mandatory law. In particular, this Section does not exclude our liability arising from our intentional misconduct or gross negligence, and does not wholly exclude our liability for damage caused by our ordinary negligence.
32.6 Some jurisdictions do not allow the exclusion of certain warranties. Where that is so, the exclusions in this Section apply only to the extent permitted, and you may have additional rights.
33. LIMITATION OF LIABILITY
33.1 To the maximum extent permitted by applicable law, and subject to Sections 33.4, 33.5 and 33.7, YoYo and its officers, directors, employees, contractors, agents and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, data or opportunity, arising out of or relating to these Terms or the Service, whether based in contract, tort, statute or otherwise, and whether or not we were advised of the possibility of such damages.
33.2 To the maximum extent permitted by applicable law, and subject to Sections 33.4, 33.5 and 33.7, our total aggregate liability for all claims relating to these Terms or the Service will not exceed the greater of (a) the total amount you paid us for the Service in the twelve months before the event giving rise to the claim, and (b) one hundred United States dollars (USD 100) or, for users contracting with YoYo KK, Ltd., fifteen thousand Japanese yen (JPY 15,000).
33.3 We are not liable for the conduct of other users, whether online or offline, including anything that happens when you meet another user in person; nor for the acts or omissions of venues, including a venue's refusal, cancellation or charge; nor for the acts or omissions of the third-party services listed in Section 24.
33.4 Japanese consumers - carve-out. If you are a consumer and your contract is with YoYo KK, Ltd.:
- nothing in these Terms excludes or limits our liability for damage caused by our intentional misconduct or gross negligence, and the caps in Section 33.2 do not apply to such damage;
- for damage caused by our ordinary negligence, our liability is limited as set out in Section 33.2 but is not excluded altogether; and
- nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the Consumer Contract Act of Japan, the Civil Code, or other mandatory Japanese law.
33.5 Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; in those jurisdictions the limitations apply only to the extent permitted.
33.6 The allocation of risk in Sections 32 and 33 reflects the fact that the Service is provided free of charge, and it is a fundamental part of the basis of this agreement.
33.7 California consumers - carve-out. If you are a California consumer, the following applies in addition to the rest of this Section, and prevails over it. Nothing in these Terms waives or limits any right, remedy or obligation created by the California Consumer Privacy Act as amended by the California Privacy Rights Act. In particular, the limits in Section 33.2 and the waiver in Section 35.5 do not apply to a claim for statutory damages under California Civil Code section 1798.150, and any provision of these Terms that purports to waive or limit such a claim is void under California Civil Code section 1798.192. Nothing in these Terms exempts YoYo from responsibility for its own fraud, for wilful injury to the person or property of another, or for violation of law, whether wilful or negligent, as provided in California Civil Code section 1668.
34. INDEMNITY
34.1 To the extent permitted by applicable law, you will indemnify and hold harmless YoYo, its affiliates, and their officers, directors, employees and agents from and against any third-party claim, and any resulting loss, liability, damage, cost or reasonable legal expense, that arises out of (a) Your Content, (b) your breach of these Terms, (c) your violation of any law or of any third party's rights, (d) your interaction with another user, including anything that occurs when you meet another user in person, or (e) a booking made in your name, including any charge a venue imposes on you.
34.2 This indemnity applies only to the extent the claim results from your own intentional act, your negligence or your breach. It does not apply to anything caused by YoYo, and it does not apply to a claim that arises without any fault on your part.
34.3 If you are a consumer, this indemnity does not require you to pay more than the amount for which you are legally responsible under applicable law, and it does not apply at all to the extent that it would be void under the Consumer Contract Act of Japan or under any other mandatory consumer-protection law that applies to you.
34.4 We will notify you promptly of any claim for which we seek indemnity, will not settle it without your consent (not to be unreasonably withheld), and will let you participate in the defence.
35. DISPUTE RESOLUTION FOR USERS CONTRACTING WITH YOYO LLC
Read this Section carefully. It affects your legal rights, including your right to go to court and to participate in a class action. It does not apply to users whose contract is with YoYo KK, Ltd.; those users should read Section 36 instead.
35.1 Informal resolution first. Before starting any formal proceeding, you agree to try to resolve the dispute informally. Send a written notice to support@yoyodatingapp.com with the subject line DISPUTE NOTICE, containing your name, the email address on your account, a description of the dispute and the relief you want. We will do the same if we have a dispute with you. The parties will attempt in good faith to resolve the dispute for 60 days from receipt of the notice. This informal process is a condition precedent to arbitration, and the 60-day period tolls any applicable limitation period.
35.2 Agreement to arbitrate. If the dispute is not resolved within 60 days, you and YoYo LLC agree that any dispute, claim or controversy arising out of or relating to these Terms or to the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, as modified by this Section. The Federal Arbitration Act governs the interpretation and enforcement of this Section.
35.3 Exceptions. This Section does not apply to (a) claims that qualify for small-claims court, which either party may bring in small-claims court instead; (b) claims for injunctive relief relating to intellectual property or to unauthorised access to the Service; or (c) any claim that applicable law does not permit to be arbitrated.
35.4 How arbitration works. The arbitration will be conducted by a single neutral arbitrator. If your claim is for USD 25,000 or less, you may choose whether it is decided on documents only, by telephone or video conference, or in person. Any in-person hearing will take place in Los Angeles County, California, or in the county where you live, at your election. The arbitrator may award the same individual relief a court could award, and the award may be entered as a judgment in any court of competent jurisdiction. The arbitrator, and not any court, decides questions about the interpretation, applicability, enforceability and formation of this arbitration agreement, except that a court decides whether the class-action waiver in Section 35.5 is enforceable.
35.5 Class-action waiver. You and YoYo LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this Section 35.5 is found unenforceable as to a particular claim or request for relief, that claim or request must be severed and brought in court, and the rest of this Section 35 continues to apply to the remaining claims. This waiver does not apply to a claim under California Civil Code section 1798.150, or to any other claim that applicable law does not permit to be waived.
Public injunctive relief is carved out. Nothing in this Section waives, and no arbitrator may decide, a claim for public injunctive relief brought on behalf of the general public under California law. If you bring such a claim it is severed and stayed and may be brought only in the state or federal courts located in Los Angeles County, California, while the arbitration of your individual claims proceeds. This carve-out is not severable: if it is held unenforceable, the whole of Sections 35.2 and 35.5 is unenforceable as to you and all of your disputes proceed in those same courts.
35.6 Costs. We will pay the arbitration filing, administration and arbitrator fees that exceed what you would have paid to file the claim in court, for claims of USD 75,000 or less, unless the arbitrator determines that your claim was frivolous. Each party otherwise bears its own legal fees, except where a statute or the arbitrator's award provides otherwise.
35.7 Your right to opt out. You may opt out of this arbitration agreement and the class-action waiver. Send an email to support@yoyodatingapp.com with the subject line ARBITRATION OPT-OUT within 30 days of the date you tap to accept version 3.0.0 of these Terms, stating your name and the email address on your account and that you are opting out. If you already held a YoYo account before August 17, 2026, your 30 days run from the date you accept version 3.0.0. If you opted out under version 2.0.0, your opt-out stands and you do not need to do it again. Continued use of the Service alone does not start that clock and does not bind you to this Section 35: we will not treat you as having agreed to arbitration or to the class-action waiver unless you have affirmatively accepted a version of these Terms containing it. Opting out costs you nothing, does not affect your account, and does not affect any other part of these Terms. If you opt out, disputes go to the courts identified in Section 37.
35.8 Changes. If we materially change this Section 35 in the future, you may reject the change by emailing us within 30 days of the change taking effect, in which case the version of this Section in force before the change will apply to disputes that have already arisen.
35.9 Survival. This Section survives termination of these Terms and deletion of your account.
36. DISPUTE RESOLUTION AND GOVERNING LAW FOR USERS IN JAPAN
36.1 Section 35 does not apply to you if your contract is with YoYo KK, Ltd. You are not required to arbitrate, and you do not waive any right to participate in a collective proceeding available to you under Japanese law.
36.2 These Terms, and any dispute arising out of or relating to them or to the Service, are governed by the laws of Japan, without regard to conflict-of-laws principles.
36.3 The Tokyo District Court is the agreed court of first instance for any dispute arising out of or relating to these Terms or the Service. This does not deprive you of any right you have under Japanese law to bring proceedings in the court for the place where you live, or of the protection of any mandatory provision of Japanese consumer-protection law.
36.4 We ask you to write to support@yoyodatingapp.com first, in Japanese if you prefer, so that we can try to resolve the matter without proceedings. This is a request, not a precondition.
36.5 Complaints about our handling of personal information may also be made to the Personal Information Protection Commission of Japan.
37. GOVERNING LAW AND VENUE FOR EVERYONE ELSE
37.1 If your contract is with YoYo LLC, these Terms and any dispute arising out of them are governed by the laws of the State of California and the Federal Arbitration Act, without regard to conflict-of-laws principles, and excluding the United Nations Convention on Contracts for the International Sale of Goods.
37.2 For any claim not subject to arbitration under Section 35, and for any claim if you have opted out under Section 35.7, the state and federal courts located in Los Angeles County, California have exclusive jurisdiction, and you and YoYo LLC consent to personal jurisdiction there. This does not deprive you of the protection of a mandatory law of the country where you live, nor of your right to bring proceedings in your local courts where that law gives you that right.
38. EXPORT CONTROL AND SANCTIONS
38.1 The app and any related technology are subject to United States export-control and sanctions laws. You may not use, export or re-export the app in violation of those laws. You represent that you are not located in an embargoed jurisdiction and are not a prohibited or restricted party, as set out in Sections 3.7 and 26.7.
39. CHANGES TO THESE TERMS
39.1 We may update these Terms as the Service changes and as the law changes. The version number and effective date at the top of this document always tell you which version you are reading.
39.2 For a material change, including a change to the Community Standards in Section 12 that would prohibit something previously allowed, a change to Section 33, 34, 35 or 36, or the introduction of fees, we will give you at least 30 days' notice by in-app notice and, where we have your email address, by email, and we will ask you to accept the new version inside the app before you continue to use the Service. If you do not accept, you may delete your account, and the previous version will continue to govern your use until you do.
39.3 For a non-material change, such as correcting a typographical error, clarifying wording, or updating a contact detail, we will publish the updated Terms with a new effective date and your continued use will be acceptance.
39.4 Corrections that make these Terms more accurate about what the app already does are not a change to your rights and are treated as non-material, even where they disclose something the previous version did not describe. Several paragraphs in version 3.0.0 are corrections of that kind.
39.5 We keep the superseded version available on request at support@yoyodatingapp.com.
39.6 Changes do not apply retroactively to a dispute that arose before the change took effect.
40. GENERAL TERMS
40.1 Entire agreement. These Terms, together with the Privacy Policy and the End User License Agreement, are the entire agreement between you and YoYo about the Service, and replace all previous versions.
40.2 Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be, severed, and the remaining provisions will continue in full force. Section 35.5 has its own severability rule.
40.3 No waiver. Our failure to enforce a provision is not a waiver of it.
40.4 Assignment. You may not assign or transfer these Terms or your account. We may assign these Terms to an affiliate, or in connection with a merger, acquisition, reorganisation or sale of assets, provided that the assignee agrees to be bound by them and that your rights are not reduced. We will tell you if that happens.
40.5 Relationship. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and YoYo, except the limited authority you give us in Section 18.7 to attempt a reservation on your behalf.
40.6 Third-party beneficiaries. Except for Apple and its subsidiaries under Section 26.10, there are no third-party beneficiaries of these Terms.
40.7 Force majeure. Neither party is liable for a delay or failure to perform caused by something outside its reasonable control, including natural disaster, earthquake, fire, flood, epidemic, war, civil unrest, labour action, governmental action, failure of a telecommunications network, power failure, or the failure or unavailability of a third-party service listed in Section 24. This does not excuse a payment obligation or affect your right to delete your account.
40.8 Notices. We give notice to you by in-app message, push notification, or email to the address associated with your account. You give notice to us at support@yoyodatingapp.com, or by post to the applicable address in Section 2.1. Notice is effective when sent, for in-app and email notice, and on delivery for postal notice.
40.9 Language. These Terms are published in English, Japanese and Chinese. The Japanese version governs for users whose contract is with YoYo KK, Ltd.; the English version governs for all other users. The Chinese version is provided for convenience.
40.10 Headings. Headings are for convenience and do not affect interpretation.
40.11 Interpretation. "Including" means "including without limitation". References to a Section are to a Section of these Terms.
